
Вашингтон, округ Колумбія. Відповідно до положень федерального законодавства, дію тимчасового захищеного статусу (TPS) для України продовжено щонайменше ще на шість місяців. Станом на сьогодні Міністерство внутрішньої безпеки США (DHS) не оприлюднило жодних нових повідомлень щодо статусу тимчасового захисту (TPS) для України; отже, згідно із законом, дія TPS для України автоматично продовжується щонайменше ще на 6 місяців (до 17 квітня 2027 року). Це зумовлено тим, що федеральний закон США — розділ 1254a(b)(3)(C) Кодексу законів США (U.S. Code) — передбачає положення щодо періодичного перегляду, припинення дії та продовження статусу.
8 USC §1254a(b)(3)(A) Періодичний перегляд
Щонайменше за 60 днів до завершення початкового періоду дії статусу (призначення) іноземної держави (або її частини) або будь-якого періоду його продовження відповідно до цієї статті, Генеральний прокурор після консультацій із відповідними урядовими відомствами зобов’язаний переглянути умови в іноземній державі (або її частині), щодо якої діє такий статус згідно з цим підрозділом, і визначити, чи продовжують виконуватися умови для надання такого статусу. Генеральний прокурор повинен своєчасно забезпечити публікацію у «Федеральному реєстрі» (Federal Register) повідомлення про кожне таке рішення (із зазначенням підстав для нього, а в разі позитивного рішення — також періоду продовження статусу відповідно до підпункту (C)).
(B) Припинення дії статусу
Якщо відповідно до підпункту (A) Генеральний прокурор визначить, що іноземна держава (або її частина) більше не відповідає умовам для надання статусу, передбаченим пунктом (1), він зобов’язаний припинити дію цього статусу шляхом публікації у «Федеральному реєстрі» повідомлення про таке рішення (із зазначенням підстав для нього). Таке припинення набуває чинності відповідно до підрозділу (d)(3), але не раніше ніж через 60 днів після дати публікації повідомлення або — якщо ця дата настає пізніше — після закінчення терміну дії останнього попереднього продовження, наданого згідно з підпунктом (C).
(C) Продовження строку визначення
Якщо Генеральний прокурор не дійде висновку відповідно до підпункту (A), що іноземна держава (або частина такої іноземної держави) більше не відповідає умовам для визначення згідно з пунктом (1), строк визначення цієї іноземної держави продовжується на додатковий період у 6 місяців (або, на розсуд Генерального прокурора, на період у 12 чи 18 місяців).

Until today, DHS has not announced any new update on Temporary Protected Status TPS for Ukraine, therefore, by operation of law the TPS for Ukraine is automatically renewed by at least 6 more months (till April 17, 2027). This is because the U.S. federal law, 8 U.S. Code (USC) Section 1254a(b)(3)(C) provides on Periodic review, terminations, and extensions of designations.
8 USC §1254a(b)(3) (A) Periodic review
At least 60 days before end of the initial period of designation, and any extended period of designation, of a foreign state (or part thereof) under this section the Attorney General, after consultation with appropriate agencies of the Government, shall review the conditions in the foreign state (or part of such foreign state) for which a designation is in effect under this subsection and shall determine whether the conditions for such designation under this subsection continue to be met. The Attorney General shall provide on a timely basis for the publication of notice of each such determination (including the basis for the determination, and, in the case of an affirmative determination, the period of extension of designation under subparagraph (C)) in the Federal Register.
(B) Termination of designation
If the Attorney General determines under subparagraph (A) that a foreign state (or part of such foreign state) no longer continues to meet the conditions for designation under paragraph (1), the Attorney General shall terminate the designation by publishing notice in the Federal Register of the determination under this subparagraph (including the basis for the determination). Such termination is effective in accordance with subsection (d)(3), but shall not be effective earlier than 60 days after the date the notice is published or, if later, the expiration of the most recent previous extension under subparagraph (C).
(C) Extension of designation
If the Attorney General does not determine under subparagraph (A) that a foreign state (or part of such foreign state) no longer meets the conditions for designation under paragraph (1), the period of designation of the foreign state is extended for an additional period of 6 months (or, in the discretion of the Attorney General, a period of 12 or 18 months).
Why USCIS or DHS has not updated Ukraine TPS page?
While the administration has not yet extended the TPS for Ukraine but due to operation of law, the TPS has been now extended.
In comming days USCIS would have to update its public information indicating the extension of TPS and validity of EAD card.
