Attorney at Adhikari Law PLLC provided public comments to the proposed rule by USCIS governing H-1B program. Besides public comments invited by the government agencies, our attorneys regularly engage with government agencies and officials to improve the legal system and the processes which impact our clients.
Our firm represents U.S. businesses seeking to retain international talents. The comments emphasizes that the government should serves the best economic interest of the U.S. by attracking the the best and brightest and those with innovative ideas. Studies have shown more than three out of every four patents at the top 10 patent-producing US universities (76%) had at least one foreign-born inventor. More than half of the patents (54%) were awarded to the group of foreign-born inventors most likely to face visa hurdles: students, postdoctoral fellows, or staff researchers. (see https://www.adhikarilaw.com/news-and-alerts/legal-alerts/increased-global-mobility-talent-present-opportunities-challenges/ citing, http://www.newamericaneconomy.org/wp-content/uploads/2013/07/patent-pending.pdf).
To be economic and leader in scientific discovery, U.S. must continue to attract the best and the brightest through higher education and by providing opportunity to talented ones to pursue innovative ideas in the U.S. than any other countries. Enrollment to U.S. colleges dipped close to two percent this year, and this is not a good news for U.S. higher education industry and for its national interest. Therefore, it is vital for USCIS to prefer foreign graduates with U.S. masters degree or higher in H-1B lottery selection process.
U.S. job market prefers someone with U.S. Master’s or PhD degree so should USCIS in its random lottery draw for H-1B quota.
